We strongly recommend submitting notices via email to ensure prompt processing. Notices submitted by any other means may experience delays.
4. Counter-Notification Procedure
If you believe that content you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated agent. A valid counter-notification must include the following:
4.1 Required Elements
Your counter-notification must contain:
a) Your physical or electronic signature.
b) Identification of the material that was removed or disabled and the location at which it appeared before removal or disabling.
c) A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
d) Your name, address, and telephone number.
e) A statement that you consent to the jurisdiction of a competent court and that you will accept service of process from the person who submitted the original takedown notice or their agent.
4.2 Processing Timeline
Upon receipt of a valid counter-notification, we will forward a copy to the original complainant and inform them that the removed material may be restored or re-enabled after a waiting period of no fewer than ten and no more than fourteen business days, unless the complainant notifies us that they have filed a legal action seeking a court order to restrain the alleged infringement.
5. Repeat Infringer Policy
Rethim Bolvex maintains a strict policy regarding repeat infringers. We will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. A user may be considered a repeat infringer if they have been the subject of multiple valid takedown notices or if they repeatedly upload or share content that infringes the intellectual property rights of others.
We reserve the right to make this determination at our sole discretion, taking into account the nature and frequency of the alleged infringement activity.
6. Misrepresentation Warning
Please be aware that submitting a false or materially misleading DMCA notice or counter-notification may expose you to civil liability, including damages, costs, and legal fees. Before submitting a notice or counter-notification, you should consult with a qualified legal professional if you are uncertain whether the material in question is infringing or whether you have a valid basis for a counter-notification.
Rethim Bolvex will not be held responsible for any legal consequences arising from a false or fraudulent notice submitted by a third party.
7. Accommodation of Standard Technical Measures
Rethim Bolvex accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works. We cooperate with rights holders and technology providers in implementing reasonable and industry-standard mechanisms for the protection of intellectual property.
